These Terms of Use ("Terms") govern your access to and use of www.tractionam.com (the "Site"), operated by Traction Asset Management ("Traction," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. Changes to These Terms

We may revise these Terms at any time by updating this page. Changes are effective when posted. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.

2. Use of the Site

The Site is provided for general informational purposes about Traction, its operating companies, and its real estate portfolio. You may use the Site only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Site in any way that violates applicable law or regulation;

• Attempt to gain unauthorized access to the Site, its servers, or any connected systems;

• Interfere with or disrupt the operation of the Site or its security features;

• Scrape, harvest, or collect information about other users or third parties without consent; or

• Use automated means to access the Site except through publicly available search engine indexing.

3. Intellectual Property

All content on the Site, including text, graphics, logos, images, and the Traction name and marks, is owned by or licensed to Traction Asset Management and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Site without our prior written consent, except for personal, non-commercial reference.

4. Inquiries and Submissions

Any information you submit through a contact, acquisition, partnership, tenant, or career form is subject to our Privacy Policy. Submitting an inquiry does not create any binding obligation on Traction to respond, engage in a transaction, or extend an offer of employment, partnership, or acquisition.

5. Confidentiality of Submissions

Traction Asset Management ("Traction") regularly evaluates a large number of acquisition, partnership, tenant, and other business opportunities. This section explains how Traction treats information submitted through the Site.

Submissions Are Not Confidential by Default

Any information you submit through the Site — including business summaries, financial information, property details, or other materials submitted through an acquisition, partnership, or tenant inquiry — is not treated as confidential or proprietary, and does not create any duty of confidentiality, fiduciary duty, or obligation on the part of Traction, unless and until Traction and the submitting party execute a separate written non-disclosure or confidentiality agreement covering that information.

Unsolicited Ideas and Proposals

Traction may already be independently aware of, evaluating, or pursuing opportunities similar to those described in an unsolicited submission. Submitting a business plan, acquisition target, or other proposal through the Site does not entitle the submitting party to any compensation, credit, exclusivity, or right to participate in any resulting transaction, absent a separate written agreement.

6. No Professional or Investment Advice

Content on the Site is provided for general informational purposes only and does not constitute investment, legal, tax, or financial advice, nor an offer or solicitation with respect to any transaction. 7. No Partnership or Agency

Traction Asset Management ("Traction") uses terms such as "partner," "partnership," and "working together" on the Site in a general business sense, to describe its collaborative approach with business owners, management teams, and tenants.

No Legal Partnership or Joint Venture Created

Nothing on the Site, and no communication with Traction through the Site, creates or should be construed as creating a legal partnership, joint venture, franchise, or fiduciary relationship between Traction and any visitor, business owner, tenant, or other party, unless and until the parties execute a definitive written agreement expressly establishing such a relationship.

No Agency or Authority

No person is authorized to act on behalf of, or bind, Traction based on any communication, inquiry, or submission made through the Site. Similarly, use of the Site does not authorize any visitor to act on behalf of, or bind, Traction.

8. Third-Party Links

The Site may link to third-party websites for your convenience. We do not control and are not responsible for the content, accuracy, or practices of any third-party site. Inclusion of a link does not imply endorsement.

9. Copyright Complaints

Traction Asset Management respects the intellectual property rights of others. If you believe content on the Site infringes your copyright, please send a written notice to [email protected] that includes:

• A description of the copyrighted work you believe has been infringed;

• The location on the Site of the material you believe is infringing;

• Your name, address, telephone number, and email address;

• A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law; and

• A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

We will review and respond to valid notices as appropriate.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

12. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, TRACTION ASSET MANAGEMENT, ITS AFFILIATES, OPERATING COMPANIES, AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

13. Indemnification

You agree to indemnify and hold harmless Traction Asset Management, its affiliates, and their respective officers, directors, employees, and agents from any claims, losses, liabilities, and expenses, including reasonable attorneys' fees, arising out of your use of the Site or violation of these Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the State of Kansas, without regard to its conflict of laws principles. Any dispute arising from these Terms or your use of the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Sedgwick County, Kansas.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, SMS / Text Messaging Terms & Consent Disclosure, Website Accessibility Statement, and Legal Disclaimers document, constitute the entire agreement between you and Traction regarding use of the Site.
